Este o cerin\u021b\u0103 fundamental\u0103 in sarcina angajatorului de a da un preaviz muncitorului privind luarea acestei masuri cu 15 zile inainte de data efectiv\u0103 de concediere, printr-o notificare scrisa.<!--more--><\/p>\n<h2>Ce prevede articolul 54 din Statutul Muncitorilor din Spania despre concediere?<\/h2>\n<p>Concedierea disciplinar\u0103: se dispune in urma unei \u00eenc\u0103lc\u0103ri grave sau foarte grave din partea muncitorului. Diferitele cauze care pot conduce la acest tip de concediere sunt incluse \u00een articolul 54 din Statutul Muncitorilor, la care ar trebui sa se adauge prevederile acordului colectiv; este vorba despre urmatoarele motive:<br \/>\n-absen\u021be repetate \u0219i nejustificate sau lipsa de punctualitate in mod repetat si nejustificat.<br \/>\n&#8211; indisciplin\u0103 \/ neobedien\u021ba fa\u021b\u0103 de superiori.<br \/>\n&#8211; incalcarea bunei credin\u021be contractuale \u0219i abuzul de \u00eencredere \u00een realizarea muncii.<br \/>\n-ofense\/insulte fizice sau verbale adresate angajatorului sau colegilor.<br \/>\n&#8211; reducerea continu\u0103 \u0219i voluntar\u0103 a productivit\u0103\u021bii \u0219i a randamentului de munca convenit.<br \/>\n-intoxicare sau dependen\u021b\u0103 de droguri, dac\u0103 acestea afecteaz\u0103 negativ performan\u021ba muncii sau prezint\u0103 vreun risc pentru muncitor sau colegii s\u0103i.<br \/>\n&#8211; hartuire pe baza de ras\u0103, etnie, religie, convingeri, v\u00e2rst\u0103, orientare sexual\u0103, sex sau dizabilitate, fa\u021b\u0103 de angajator sau colegi.<a href=\"https:\/\/www.marinpasalodos.com\/wp-content\/uploads\/2017\/05\/acoso-stalking.png\"><img decoding=\"async\" class=\"alignright size-medium wp-image-27395\" src=\"https:\/\/www.marinpasalodos.com\/wp-content\/uploads\/2017\/05\/acoso-stalking-300x189.png\" alt=\"acoso o stalking\" width=\"300\" height=\"189\" srcset=\"https:\/\/www.marinpasalodos.com\/wp-content\/uploads\/2017\/05\/acoso-stalking-300x189.png 300w, https:\/\/www.marinpasalodos.com\/wp-content\/uploads\/2017\/05\/acoso-stalking-500x314.png 500w, https:\/\/www.marinpasalodos.com\/wp-content\/uploads\/2017\/05\/acoso-stalking.png 700w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Concedieri colective: acesta este un mecanism de munc\u0103 cunoscut sub numele de ERE (Dosarul de Reglementare a For\u021bei de Munc\u0103), care vizeaz\u0103 reducerea semnificativ\u0103 a for\u021bei de munc\u0103 \u00een perioadele de criz\u0103 de afaceri.<\/p>\n<p>Odat\u0103 ce s-a stabilit tipul de concediere aplicabil, este extrem de important s\u0103 cunoa\u0219te\u021bi prevederile legale ce reglementeaza felul acestei masuri, deoarece, dac\u0103 nu se respecta, concedierea va fi considerat\u0103 ilegal\u0103, chiar dac\u0103 exist\u0103 motive ce o justifica. Procedura presupune instiintarea angajatului printr-o comunicare scrisa de concediere, cerin\u021ba esen\u021bial\u0103 pentru ca masura concedierii sa fie legala(justificat\u0103); in aceasta, se indica data concedierii \u0219i motivele acesteia, precum \u0219i tipul de concediere.<\/p>\n<p>Daca are loc o concediere obiectiva, lucr\u0103torul trebuie s\u0103 primeasc\u0103 o indemnizatie. Dac\u0103 sumele primite sunt incorecte (cu excep\u021bia unei erori scuzabile), s-ar putea considera ca fiind o concediere abuziv\u0103.<\/p>\n<h2>Legalitatea sau ilegalitatea concedierii<\/h2>\n<p>Din momentul primirii comunicarii de concediere, exista un termen de 20 de zile lucr\u0103toare pentru a contesta aceasta masura. \u00cenainte de demersul judiciar, procedura prealabila obligatorie consta in depunerea la CMAC \/ SMAC (Centrul \/ Serviciul de mediere, arbitraj \u0219i conciliere) a unei cereri de conciliere, in scopul de a se ajunge la un acord intre angajator si muncitor; \u00een cele din urm\u0103, un judecator va hotari cu privire la legalitatea , ilegalitatea sau nulitatea concedierii. Depunerea cererii de conciliere intrerupe termenul mentionat \u2013 pana la data concilierii, cu un maxim 15 zile lucratoare.<\/p>\n<p>\u2022 \u00cen cazul \u00een care concedierea este declarat\u0103 nul\u0103, nu va opera nicio indemnizatie. Lucr\u0103torul trebuie reincadrat in functie, fiindu-i platite toate salariile neprimite de la momentul concedierii p\u00e2n\u0103 la notificarea sentintei. Cazurile in care o concediere poate fi declarata nula sunt stabilite in articolul 55, punctele 5 si 6 din Statutul Muncitorilor.<br \/>\n\u2022 \u00cen cazul \u00een care concedierea este declarat\u0103 legala:<br \/>\n&#8211; \u00cen cazul concedierii disciplinare, se va realiza \u00eencetarea raportului de munc\u0103, fara a da na\u0219tere la niciun tip de indemnizatie.<br \/>\n&#8211; Dac\u0103 este o concediere din motive obiective, se va confirma legalitatea motivului indicat in notificarea de concediere, consolidandu-se deci incheierea relatiei laborale.<br \/>\n\u2022 va exista o concediere ilegala atunci c\u00e2nd nu exist\u0103 dovezi privind motivul concedierii, sau c\u00e2nd nu au fost respectate cerin\u021bele formale ale procedurii legale privind aceasta masura. \u00cen acest caz, angajatorul trebuie s\u0103 decid\u0103 \u00een termen de cinci zile de la notificarea sentintei dac\u0103 opteaz\u0103 pentru reincadrarea lucr\u0103torului la locul de munca, sau dac\u0103 va plati compensa\u021bia pentru concediere ilegala. Dac\u0103 \u00een acest termen lucr\u0103torul nu decide nimic, se va \u00een\u021belege c\u0103 el opteaz\u0103 pentru a-l reincadra la locul de munca.<\/p>\n<p>Daca doriti sa aflati mai multe informatii despre implicatiile juridice ale masurii de concediere, sau v\u0103 afla\u021bi \u00eentr-o situa\u021bie \u00een care considerati ca sunt aplicabile prevederile legale din aceast\u0103 materie \u0219i ave\u021bi nevoie de avocat, respectiv de \u00eendrumare juridic\u0103, nu ezita\u021bi s\u0103 ne contacta\u021bi.
